Agency relationships can certainly be confusing. Every state has different laws and regulations regarding the capacity of an agent to represent a buyer and/or seller in every transaction. I felt like some clarification might be in order. |
Relationship in Real Estate

The first real estate document in the state of Montana for a consumer might be the Relationships in Real Estate. The Relationship in Real Estate form will describe in detail the possible relationships and what they mean to each party involved in the transaction. You can review, for example, exactly what responsibilities the sellers’ agent has to the seller and what responsibilities they have towards the buyer. On the second page, your agent will check the boxes that may pertain to the transaction at hand. |
Company Policy on Agency Relationships

The second document to review will then be the Company Policy on Agency Relationships. This document will inform the buyer or seller exactly what relationships are allowed within the chosen company representing you. Not all real estate firms will allow all of the relationship types that the state may allow. For example, Bozeman Montana Real Estate does not allow for a Statutory Agency relationship wherein they do not represent either party in the transaction. The Company Policy will further outline what can be expected from the real estate agent. |
The final document to review will be the document that, in writing, provides for the transaction you are wanting. For sellers, this is easy, it is the listing agreement. For buyers, it can be become a bit more complicated depending on whether or not you are working with the listing agent. If a buyer working with the listing agent will enter into a dual agency situation and the information presented to the buyer will be subject to the rules of confidentiality. If the buyer is not working with the listing agent, then the buyer may be signing a Buyer Broker Agreement which will outline the obligations of the agent toward the buyer and the buyer toward the agent. Every agreement is different, and every agreement is negotiable with regard to terms and expiration dates. Take the time to discuss this with your chosen agent at the earliest moment in your quest for a home so you have a clear understanding of what the agents responsibilities are toward you! In closing, agency agreements are not to be feared. Instead, they should be embraced! They should clearly define what your expectations should be and help provide for a smooth, satisfactory transaction. |
